Se confirmó el Auto de rechazo proferido por el Despacho del Magistrado Rodrigo Escobar Gil en el proceso D-4843.
La Corte aceptó que el debate acerca del desistimiento de la demanda de inconstitucionalidad presenta un interés jurídico claro, pero también admite que el mismo es impertinente en el caso sub judice.
Por último, no podría argüirse que la decisión de rechazar la demanda por no haberse corregido el libelo genere consecuencias desfavorables para el impugnante, que en cambio invocaba la figura del desistimiento, ya que el rechazo no hace tránsito a cosa juzgada constitucional y la demanda puede volver a presentarse en cualquier momento.
